Patients’ Rights and Responsibilities

TWL Elevare Licensed Behavior Analyst PLLC (Elevare ABA)

Elevare ABA is committed to upholding the dignity, autonomy, and rights of every individual and family we serve. We provide care with compassion, respect, and professionalism, and we actively promote awareness of patient rights among all staff. We recognize that true quality of care comes not only from policies but from a shared value system that centers the well-being of each patient.

Patient Rights

  1. Respectful and Non-Discriminatory Care Patients have the right to appropriate, respectful, and compassionate care regardless of race, color, religion, national origin, age, sex, gender identity or expression, sexual orientation, marital status, disability, socioeconomic status, or source of payment.
  2. Cultural Sensitivity We respect and integrate each patient’s psychosocial, cultural, and spiritual values into their care whenever possible.
  3. Identification of Staff Patients have the right to know the identity and role of individuals providing their care.
  4. Information About Care Patients have the right to receive clear, understandable information about their diagnosis, treatment plan, and prognosis unless not medically advisable. When appropriate, legally authorized representatives may receive this information.
  5. Safety Patients have the right to receive services in an environment that prioritizes safety and minimizes risk.
  6. Advance Directives Patients may create and expect recognition of advance directives in accordance with state law.
  7. Refusal of Services Patients have the right to refuse treatment, to the extent permitted by law, and to be informed of the consequences of that decision.
  8. Research Participation Patients have the right to be informed of any research or educational involvement and to refuse participation without affecting their care.
  9. Service Access Patients can expect a timely response to service requests based on clinical need and organizational capacity.
  10. Freedom from Restraints Patients have the right to be free from physical or chemical restraints, unless required to protect the individual or others, and in accordance with law.
  11. Access to Records Patients may request to view or receive a copy of their medical records in accordance with HIPAA regulations.
  12. Confidentiality Patients’ records and communications are protected and will not be released without written consent unless required by law.

  14. Filing Complaints Patients and guardians may file complaints about care without fear of retaliation by contacting Elevare ABA directly.
  15. Continuity and Discharge Planning Patients have the right to continuity of care and to be involved in discharge planning and discussion of ongoing treatment needs.
  16. Financial Transparency Patients may request a clear explanation of costs related to their care and services.
  17. Consent Patients have the right to informed consent before any treatment begins, including discussion of alternatives when available.
  18. Communication of Outcomes Patients and families will be informed of outcomes of care, including any unanticipated results.
  19. Dosage Recommendations Our BCBAs determine recommended treatment hours based on assessment results, behavioral needs, and scheduling availability—not on funder restrictions or convenience. These recommendations are shared and explained to families transparently.

Patient Responsibilities

Patients and families play a vital role in successful treatment and are encouraged to:

  • Follow Elevare ABA policies and instructions.

  • Ask questions if they do not understand the treatment plan.
  • Follow the agreed-upon treatment plan or communicate concerns.
  • Notify us of changes in condition or if problems arise.
  • Fulfill financial obligations or inform us if payment is an issue.
  • Report concerns or potential risks in care or treatment.
  • Participate actively in promoting a safe and respectful environment.

Abuse Prevention & Mandated Reporting

Elevare ABA enforces a zero-tolerance policy for abuse, neglect, or exploitation of clients. We are committed to creating a safe and respectful space for all individuals receiving care.

Mandated Reporting

All Elevare ABA staff are mandated reporters. If there is any suspicion of abuse or neglect, staff are legally required to report it to the appropriate state or local authorities. This includes, but is not limited to:

  • Physical abuse
  • Sexual abuse
  • Emotional abuse
  • Neglect (e.g., inadequate food, shelter, clothing, supervision)

Reports are confidential and made in the best interest of the child’s safety and welfare. Failure to report suspected abuse is a violation of the law.

Abuse Prevention Policy

We take proactive measures to prevent abuse, including:

Staff Screening

  • Background checks, including criminal history and sex offender registry
  • Multiple professional references
  • Annual re-screening of relevant personnel

Training

  • Staff receive abuse prevention and reporting training at hire and annually
  • Training includes how to recognize, respond to, and report suspected abuse

Treatment Environment Guidelines

  • In-clinic: At least two staff present with clients at all times
  • In-home: A responsible adult must be present
  • Community: Staff are trained to manage client safety respectfully in public

Professional Boundaries

Staff must maintain strict physical, social, and sexual boundaries with clients and families. Inappropriate language, physical contact, social media contact, or interactions outside of work responsibilities are prohibited.

Evidence-Based Practices Only

Elevare ABA only provides evidence-based ABA services supported by peer-reviewed research. We do not implement or recommend therapies that lack scientific validation.

If a family is using a non-evidence-based intervention:

  • We will educate the family during parent training about potential risks
  • If it interferes with ABA, we may request the intervention stop
  • If unresolved, Elevare ABA may consider discharge from services

We do not provide or support the following:

  • Chelation therapy
  • Lupron therapy
  • Hyperbaric oxygen therapy
  • GFCF diets (for treatment of autism, unless medically necessary)
  • Stem cell therapy
  • Secretin injections
  • Antifungal agent therapy
  • Raw camel milk
  • Marijuana or nicotine therapy
  • Bleach therapy
  • Transcranial magnetic stimulation (TMS)
  • Dolphin-assisted therapy
  • Holding therapy
  • Prism glasses
  • Horseback riding as therapeutic intervention

Why this matters: Many of these treatments are not only ineffective, but some are dangerous or exploitative. Elevare ABA promotes critical thinking and scientific literacy to protect families from misinformation and financial exploitation.
